Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sealitto website and platform ("Sealitto", the "Platform", "we", "us"). Sealitto is operated by [operating entity — to be completed], registered at [registered office address], VAT [VAT number]. By creating an account or making a booking you agree to these Terms.

1. What Sealitto is

Sealitto is an online marketplace that connects people who want to rent boats ("Renters") with private owners and professional charter operators who offer them ("Owners"). The boats are listed and operated in Italy, starting in Sicily.

Sealitto is an intermediary. The rental contract for any boat is concluded directly between the Renter and the Owner. Sealitto is not the owner, operator, or charterer of any boat and is not a party to the rental contract, except where a listing is explicitly marked as operated by Sealitto.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Platform. You are responsible for the accuracy of the information you provide and for all activity under your account.

Keep your login credentials confidential. Tell us promptly at info@varamedia.be if you suspect unauthorised use of your account.

3. Listings and Owner obligations

Owners are solely responsible for their listings, including the accuracy of descriptions, photographs, specifications, availability, pricing, and the legal compliance of their boats.

Owners warrant that each boat is seaworthy, lawfully registered, properly insured for commercial rental where required, equipped with valid safety equipment, and compliant with all applicable maritime and local regulations.

4. Bookings and the rental contract

A booking is a request to enter into a rental contract with the Owner. Depending on the listing, a booking is confirmed instantly or after the Owner accepts it. The rental contract takes effect when the booking is confirmed.

You agree to use the boat only as permitted by the Owner, the listing, and applicable law, including any navigation limits, passenger limits, and return times.

5. Boating licence and renter qualification

Italian law requires a valid boating licence to operate certain boats (broadly, those with engines above 40.8 kW / about 30 HP, or navigating beyond defined limits). Where a listing requires a licence, you must complete the qualification step and provide valid documents before the trip.

If you do not hold the required licence, you may still book boats that need no licence, or add a professional skipper. Providing false licence information is grounds for cancellation without refund and may be unlawful.

6. Prices, fees and payment

Prices are set by Owners. The price you pay includes the boat rental, a Renter service fee, any add-ons you select, and applicable taxes. The full amount is shown before you pay.

Payments are processed by our payment provider, Stripe. Sealitto retains a commission from the Owner and the service fee. A refundable security deposit may be collected or held separately and is not part of Sealitto’s revenue.

7. Add-ons and experiences

During checkout you may add optional extras such as a skipper, fuel, catering, transfers, photo or video services, and protection products. Add-ons are fulfilled by the Owner, by vetted third-party suppliers, or by Sealitto, as indicated at checkout.

Third-party add-ons are subject to the supplier’s own terms. Sealitto is not liable for the acts or omissions of independent suppliers.

8. Cancellations, refunds and security deposits

Cancellations and refunds are governed by the Cancellation Policy, which forms part of these Terms. Security-deposit handling, damage claims, and dispute resolution are described there and in the listing.

9. Conduct, safety and responsible use

Renters and any operator they designate must operate the boat safely and lawfully, respect passenger and weather limits, and never operate a boat under the influence of alcohol or drugs. You are responsible for the safety of everyone on board.

You must not misuse the Platform, post unlawful or misleading content, attempt to circumvent Sealitto to avoid fees, or use the Platform for any fraudulent or illegal purpose.

10. Reviews and user content

You may submit reviews and other content. Content must be accurate, lawful, and respectful. You grant Sealitto a non-exclusive, worldwide, royalty-free licence to host and display your content in connection with the Platform.

We may remove content that breaches these Terms or applicable law.

11. Intermediary role and disclaimers

Because Sealitto is an intermediary, we do not control and are not responsible for the condition, legality, or safety of any boat, or for the conduct of Owners or Renters. The Platform is provided "as is" and "as available".

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including mandatory consumer-protection rights.

12. Limitation of liability

To the maximum extent permitted by law, Sealitto is not liable for indirect or consequential loss, and our total aggregate liability arising from a booking is limited to the total service fees Sealitto received for that booking.

This clause does not affect liability for death or personal injury caused by negligence, for fraud, or any liability that cannot be limited under applicable law.

13. Suspension and termination

We may suspend or close an account that breaches these Terms, creates risk to other users, or is used unlawfully. You may close your account at any time; obligations relating to completed or pending bookings survive closure.

14. Changes to these Terms

We may update these Terms to reflect changes to the Platform or the law. Material changes will be notified through the Platform or by email. Continued use after changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by Italian law, without prejudice to the mandatory consumer protections of your country of residence in the EU.
